Terms of Use of the Binero Application

1. Purpose
These Terms of Use (the “Terms”) govern access to and use of the mobile application Binero (the “Application”), published by BoCode EI (the “Publisher”). By installing and/or using the Application, the user unconditionally agrees to these Terms.
2. Access and Eligibility
- The Application is reserved for individuals aged at least 16 years.
- The user is responsible for the accuracy of information provided and for keeping their credentials confidential.
- The Publisher may restrict access at any time, including for maintenance, updates or security reasons.
3. Operation, Ads and Paid Content
- The Application is currently free. Paid content (packs, subscriptions) may be introduced in future updates.
- Advertisements may be displayed within the Application.
- Certain features, content or rewards may be subject to specific conditions communicated in‑app.
4. Intellectual Property
The Application and all of its components (source code, architectures, design, graphics, databases, texts, sounds, logos, trademarks) are protected by intellectual property law and remain the exclusive property of the Publisher or its partners.
Any reproduction, representation, adaptation, decompilation, reverse engineering, attempt to extract source code, modification, translation, distribution or unauthorized exploitation, in whole or in part, is strictly prohibited and may result in civil and/or criminal proceedings.
5. Prohibited Uses (cheating, reverse engineering, MITM, hacking)
It is strictly prohibited to use the Application to:
- Cheat or automate gameplay: bots, scripts, macros, emulators, memory editors, or any manipulation aimed at altering gameplay, leaderboards, scores, rewards or statistics.
- Exploit or misuse features: taking advantage of bugs, glitches or design flaws, bypassing anti‑fraud checks, or falsifying progress/saves.
- Commit technical attacks: network attacks, MITM, interception, injections (SQL/JS/command), malicious reverse proxies, denial of service, brute force, privilege escalation, unauthorized scraping, malware deployment.
- Perform reverse engineering: reverse engineering, decompilation, disassembly, inspection or modification of packages, APKs, assets, protocols or security keys.
- Compromise the integrity of communications: capture, alteration, replay, forgery or delayed replay of exchanges between the Application and servers.
- Make unlawful or unauthorized commercial use, resell accounts, or generate artificial ad traffic.
Any suspicious behavior may lead to immediate measures (see section 7) and, where appropriate, legal action.
6. Security and Service Integrity
- The Publisher implements reasonable technical and organizational measures (encrypted communications, server controls, anomaly detection). As no measure offers absolute security, the user accepts the inherent risks of using the Internet.
- The Publisher reserves the right to implement and adapt anti‑fraud/anti‑cheat mechanisms at any time.
- The user undertakes to promptly report any vulnerability discovered and to refrain from exploiting it.
7. Enforcement, Suspension and Termination
In case of a breach of these Terms, the Publisher may, at its sole discretion and without prior notice, apply any of the following measures:
- Warning, resetting progress or removal of content obtained irregularly;
- Temporary or permanent suspension of access to the Application;
- Deletion of the account and related data in compliance with applicable regulations;
- Referral to competent authorities and/or civil and/or criminal legal action.
8. Warranties and Liability Limitation
- The Application is provided “as is” and without warranty of availability, performance or error‑free operation.
- The Publisher shall not be liable for interruptions, outages, data loss, security breaches or indirect, non‑material, special or consequential damages.
- If the Publisher’s liability were to be established, it would in any event be limited to the amounts, if any, paid by the user during the previous twelve (12) months, except in cases of gross or willful misconduct and without prejudice to mandatory legal provisions.
- The user remains responsible for their equipment, connection and the confidentiality of their credentials.
9. Third‑Party Services
The Application may integrate third‑party services (e.g., Google Firebase, Crashlytics, Analytics, AdMob). Their use is subject to their respective terms and policies. The Publisher is not responsible for third‑party services or third‑party content or ads.
10. Changes to the Terms and the App
The Publisher may change these Terms or the Application at any time to improve the service, enhance security, comply with legal developments or add/remove features. Material changes may be notified in‑app.
11. Governing Law and Jurisdiction
These Terms are governed by French law. Any dispute relating to their performance, interpretation or validity shall be submitted to the competent courts of Lyon, subject to applicable mandatory rules.
